Delhi HC grants more time to judicial commission for probe in lawyers-police conflict

A bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad noted that it has received a request from Justice (retd) SP Garg, head of the commission set up by the court, for extension of time to conclude the inquiry.

“The request made by letter dated 25.07.2022 reveals that some more time is required, and, therefore, in the interest of justice further five months are granted from today to complete the inquiry”, said the court in its order dated 8 August.

In January, the court had given time till 31 July to the commission to conclude its inquiry given the COVID-19 pandemic situation and the number of witnesses needed to be examined.

The court noted in its decision that 338 witnesses had been questioned, and a small number of more witnesses would probably be questioned once the forensic and ballistic findings were received.

The commission had interviewed 124 witnesses up to that point, and more needed to be interviewed, as per an earlier report furnished by the commission in 2020.

On 2 November 2019, an altercation between a lawyer and a police officer who was on duty about parking at the court complex led to the injuries of over 20 police officers and several attorneys.

By means of an interim injunction, the High Court had shielded attorneys from any repercussions related to FIRs filed in connection with the incident on 2 November while the legal investigation is ongoing.

The protection of two police officers against whom FIRs were filed in connection with the incident received a similar order.
