MCD resumes Uttam Nagar demolition after tribunal dismisses relief plea

A day after the Appellate Tribunal of Municipal Corporation of Delhi vacated the stay on demolition, the corporation resumed action on unauthorised constructions and razed illegal portions of a house on Thursday, linked to one of the accused in the Uttam Nagar Holi clash case, in which a 26-year-old man was killed, officials said.

According to officials, the action followed after the tribunal on April 29 dismissed an interim application filed by family members of a man in judicial custody, seeking protection against demolition and sealing action at properties in JJ Colony, Hastsal in Uttam Nagar.

The case concerns buildings allegedly constructed by merging multiple residential units. In one instance, three houses were combined into a single structure, while in another, two units were merged, drawing action from civic authority after the appellate tribunal vacated the stay order, according to officials.

Affected parties had approached the Delhi High Court on April 13 against the MCD’s demolition drive, which was taken up in March. The court granted them a 15-day interim relief earlier this month and directed them to file an appeal before the Appellate Tribunal of the MCD (ATMCD), the officials said

The petitioners subsequently moved to the tribunal on April 28, and the matter was taken up for hearing on April 29.

On Wednesday, after hearing the arguments, the tribunal vacated the stay and upheld the MCD’s action, clearing the way for the civic body to proceed.

Following the tribunal’s order, MCD teams returned to the site on Thursday morning and resumed the demolition exercise, officials confirmed.

According to the order, the tribunal dismissed the interim application, observing that there was no prima facie case, and the balance of convenience also did not favour the appellants. No stay on demolition was granted.

Both appeals have been listed for final arguments on June 11, 2026.

On March 4, Tarun was killed in a clash that broke out between his family and their neighbours in the JJ Colony area in West Delhi. The violence broke out after water from a balloon thrown by a girl from Tarun’s family splashed on a woman from his neighbour’s family, according to the police.
