Subramanian Swamy gets 6 weeks to vacate Govt residence earlier allotted for security reasons

The Delhi High Court on Wednesday directed BJP leader and former Rajya Sabha MP Subramanian Swamy six weeks to vacate the government apartment allotted to him back in 2016 due to a security concern.

The court’s order came after the state argued that it is not required to provide housing for people receiving security cover.

Swamy had sought a reallotment of the residence following the expiry of five years time period.

In January 2016, the Centre gave Swamy a home in Delhi for five years.

Throughout his time in the Upper House, which ended in April 2022, he remained there. As he was about to leave the property, Swamy went to the Delhi High Court to request a re-allotment of the bungalow due to the ongoing threat to his security. He still qualifies for Z category protection.

Speaking on behalf of the ministry of home affairs, Sanjay Jain informed the court that the security agencies will give their services at Swamy’s private property in Nizamuddin East even if they were unable to extend the accommodations.

Jain also informed the court that Swamy had been designated as an unauthoritarian occupant of the premises in accordance with the Public Premises Act.

Jain continued by saying that the government must make accommodations for the council of ministers and the additional judges at the Delhi High Court.

Therefore, the single-judge bench of Justice Yashwant Varma dismissed Swamy’s request for re-allotment of his house, where he has been residing since January 2016, due to threats to his safety.

“The court observes that the allocation was established for a five-year term, and that time has passed. The court stated in its judgement that it had not presented any documentation that mandated or required the allocation of government housing to Z category protected individuals”, Varma stated.
